Terms and Conditions

​Welcome to Simuluxor.com. These Terms and Conditions ("Terms") govern your use of the Simuluxor.com website and the rental of simulator equipment and associated services (collectively, the "Services") provided by Simuluxor ("we," "us," or "our"). By booking a rental, using our website, or using our equipment, you ("Customer," "you," or "your") agree to be bound by these Terms.

​1. Acceptance of Terms

​By placing a booking through Simuluxor.com, you confirm that you are at least 18 years of age and possess the legal authority to enter into this agreement. If you are booking on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

​2. Booking, Payment, and Deposits

  • Currency & Taxes: All prices are listed in Canadian Dollars (CAD) and are subject to applicable Harmonized Sales Tax (HST).
  • Deposits: A non-refundable security deposit of 50% is required at the time of booking to secure your reservation. The remaining balance is due 48 hours prior to the scheduled delivery or event date.
  • Damage Deposit: We reserve the right to require a pre-authorized credit card hold of $500 prior to equipment handover to cover potential damages. This hold will be released within 3-5 business days following the safe and undamaged return of the equipment.

​3. Cancellations and Refunds

  • Customer Cancellations: Cancellations made more than 7 days before the rental date will receive a full refund, minus the non-refundable deposit. Cancellations made within 7 days of the rental date are non-refundable.
  • Simuluxor Cancellations: In the rare event that Simuluxor must cancel a booking due to unforeseen circumstances (e.g., equipment failure, severe weather impacting delivery), a full refund of all amounts paid, including the deposit, will be issued.

​4. Delivery, Setup, and Collection

  • Site Requirements: The Customer is responsible for ensuring the delivery location has adequate space, appropriate power sources (standard 120V AC outlets), and a safe, dry environment for the equipment.
  • Access: The Customer must ensure our team has clear, unobstructed access to the venue for delivery, setup, and teardown during the agreed-upon windows.
  • Delays: Simuluxor is not liable for rental time lost due to venue access issues or lack of appropriate power sources.

​5. Equipment Use and Responsibilities

  • Proper Operation: The Customer agrees to use the simulator equipment strictly for its intended purpose and in accordance with all provided instructions and safety guidelines.
  • Prohibited Actions: No food, beverages, or sharp objects are permitted on or immediately adjacent to the simulator equipment. The Customer shall not attempt to move, modify, repair, or alter the equipment once set up by Simuluxor staff.
  • Supervision: The Customer is responsible for supervising all users of the equipment during the rental period to prevent misuse, damage, or injury.

​6. Damage and Loss

​The Customer assumes full financial responsibility for all equipment while it is in their possession (from setup completion until Simuluxor staff arrives for teardown).

  • ​If the equipment is damaged, lost, or stolen due to the Customer’s (or their guests') negligence, misuse, or failure to secure the premises, the Customer will be charged for the full cost of repair or replacement, plus any lost rental revenue during the repair period.

​7. Assumption of Risk and Liability Waiver

  • Health and Safety: Simulators may cause motion sickness, dizziness, or disorientation in some individuals. Users with pre-existing medical conditions (including but not limited to heart conditions, epilepsy, or pregnancy) should consult a physician before use.
  • Waiver: To the maximum extent permitted by Ontario law, Simuluxor, its owners, employees, and affiliates shall not be held liable for any personal injury, property damage, loss of income, or any incidental, indirect, or consequential damages arising from the use or inability to use the rented equipment.
  • Indemnification: The Customer agrees to indemnify and hold harmless Simuluxor from any third-party claims, lawsuits, or demands resulting from the Customer's event or use of the equipment.

​8. Privacy Policy

​We collect and use personal information (such as names, addresses, and payment details) solely for the purpose of processing bookings and providing our Services, in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy laws. We do not sell your data to third parties.

​9. Force Majeure

​Simuluxor shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from causes outside our reasonable control, including but not limited to acts of God, severe weather, pandemics, labor disputes, or localized power outages.

​10. Governing Law

​These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal disputes arising from these Terms or the rental agreement shall be resolved in the courts located in Ontario.

​11. Amendments

​Simuluxor reserves the right to update or modify these Terms at any time without prior notice. The Terms in effect at the time of your booking will govern your rental.
